Thread: when someone uses your image without permission...

What can i do ?

I have had this problem in the past when someone used my picture for an entertainment agency, where i didnt work. I had to ask many many times for the owner to remove it and it was removed 1 or 1.5 year after many requests.

Now I have the same problem again, someone using my picture and bio without my permission cause I am not working there...I ask that they remove everything but of course no response ,m::

what can i do ?? I would make that page disappear if i could , it is so annoying...

Cease and desist letter? Describe all the instances in which your image has been used without your permission and mention that you will be sending a copy of said letter to your counsel (even if you don't have one)?

I started to have the same problem when my website went online, but when I put a copyright warning at the bottom of my index page and gallery page people started calling me to used them and of course they have to pay for it.

I one time had to sent a registered letter to a person stating that I was going to take them to court if they did not take down my picture. It worked, scared the poopoo out of him.

UK / EU photographic copyright law is very straight on this one. This is what you should do:

Go to this government website:

Photographs

Then go to the bit that applies to you, print it off and send it to whoever is breaching this copyright together with a letter documenting their breach. Tell them that unless they have removed the image(s) within 48 hours you are passing this on to the authorities to deal with. That should put a stop to it.

Incidentally you may not own the copyright on those photos yourself - who took them?

The pictures were made by a photographer.
but the thing the website puts my bio+picture ( and also from another dancer) claiming we are associates (?) like i co-own the thing or wathever ...
absolutely not true, this bothers me.

I just want to cyber kick their a**. if was a pirate i would just make that page go away.
i just have no response from the owner of the site.
what if they dont answer after i threaten them with going to court?
I really dont have money to waste on a lawyer it is so ridiculous.
not sure i have an adress to send an official letter to them...

In that case, I would:

1 - do a quick google to get some printed off advice similar to that on the link - there must be some, somewhere.

2 - do screen dumps of the pages in question, where your images and info are used

3 - write a coherent statement, not rambly like my usual posts, just get the facts down

Do you have a website?

Put something up to say that one or two oddball websites are using your image and information without your permission. Warn others not to do the same. Tell them you don't bother prosecuting, you let the authorities deal with it, as they are very efficient and leave you to get on with your job. This might be a blag but what the hell? Maybe in Canada they do deal with things like that in that way - a criminal offence rather than a civil offence or whatever. They may do in the UK but I haven't had to take anything that far yet.

Don't waste money on the b*stards, and as little time as possible too. Tell us more, or ask more questions . . . do you know these people at all? Are you a random choice?

And Salomestar's advice is dead on, put a copyright notice on your website. And change all your pics on your website so that when the user does a "right-click" onthe image that little window shows and instead of giving a menu it says something like:

Your IP address has been noted and if this image is copied we will prosecute

or whatever

Says she who copies music all the time, has done since the advent of cassette tapes. Slap of wrists there and some food for thought ... but then I don't say "such and such musician is associated with my company" unless they actually are ... hmm

You should let the photographer know that they are using their photos w/o permission...I bet the photog will give them lots of trouble...that is what I would do! LOL

That's surprising it's the photographer doing it. Photog should know better. *tsk tsk*
