They stole my photos - did they steal yours?
Several of the photos in this youtube video were stolen from my web site. There were several showing Turkish dancers in performances I saw in 2000, and there's one of me.
In the link below, click on the text title at the top of the box that says "YouTube - Şımarık -Tarkan (Kiss kiss Remix)" rather than clicking on the arrow in the middle of the image.

who made this video? was it Tarkan or someone just using his song and your website photos and videos?

Click the title of the vid. The person who posted this has disabled embedding. this is a photo montage set to Tarkin's song. I think I recognized Sandra at the end as well as Shira with a sword!

I see it now, didn't watch the entire thing, but I'm thinking none of those people probably know that there pictures are being used on it.

Eh, it's no different than fans making fanvids with random porn off the internet, or clips from TV shows, only crappier than most. Nobody's making any money out of it. It's like scrapbooking.

It has been taken down now with the explination that there is a third party copyright complaint.

I see your point, and I agree that this particular clip was inoffensive. And yes, I realize that the person who created it was probably not making any money off it. However...
I don't know whether it would apply to this particular situation, but in the U.S. the law pretty much says that if you don't enforce your intellectual property by objecting when it is used without your permission, then you lose the right to enforce it. In other words, you need to be consistent. If you let some people use your stuff without asking them to stop, then you lose the right to demand that other people stop.
For that reason, I always ask people who infringe my copyright to stop infringing.

I see your point, Shira, but in the area of "transformative works" most copyright holders don't bother. It's a massive grey area. Most television and film companies do not enforce copyright over stills and very short clips from their shows and films, or the use of the characters they own in fanfic etc (same goes for authors). It's one of the chief reasons why fen don't do what they do for money. Only when money comes into it is there a problem, as we can see at the moment with the Harry Potter Lexicon situation, where the work-for-publication is very clearly just a compilation of quotes and contains very little original material.
It's fair enough that people don't want their pix used and if you find them, for you to ask people to stop, but if it's on the internet and not locked it's going to be used and you can't always know for sure.
