    photo/video clause in contract?

I've been checking out other dancers' performance contracts online, and I haven't seen any that say anything about clients taking photos or videos and what happens with the pics and vids afterwards.

does anybody have a clause in their contract that restricts the client's use of a video? something like, can only be used for personal use and may not be distibuted in any manner without permission?

if you do have that in your contract, would you mind sharing the wording?

Mine says: Photography and videotaping of the bellydancer is permitted. Footage must only be used for private purposes (such as wedding videos). Showing or distributing footage of the dancer in a public arena, including uploading onto the internet, is strictly prohibited.

However, what I'd really like to say is 'uploading of unflattering photos or videos onto the internet is strictly prohibited. One the other hand, kick arse footage is welcomed...in fact, I demand you give me a copy, and post it everywhere with comments like "This dancer is awesome! Hire her" alongside a link to my website.'

i've had clauses for corporate gigs, where i ask for copyes of the video/foto material send to me

i've had clauses in private party contracts (the rare occasion there is a contract) saying that video/photo is allowed for private not commercial use.

    Re: photo/video clause in contract?

    Mine reads:

Photography/Video: Photographing and videotaping Galatea’s performance(s) is allowed solely for personal/family use. However, no photographs or video are to be sold/distributed commercially without the performer’s prior permission and written consent. It is the responsibility of the client to enforce this clause

I have decided not to include any verbiage about restricting uploads to the internet, because I know a lot of people share their pictures and videos with friends and family that way. I know some people's mileage may vary with that, but as long as all they are showing is my performance (as opposed to me getting changed in the bathroom), I don't have a problem with it.

When I send my usual thank you email to the client, I will mention that I would love to see any pictures or video taken by the guests if they would like to share it with me. A small handful have sent me some pictures, and with their permission I've even used a few on the booking page of my website.

Can you please tell me more about this thank you e-mail? Should I start another thread? You can PM me if you don't want the thread to veer off topic.

I just send a quick email out within 24 hours of the gig, something like this:

    Hi Sally!

I just wanted to thank you again for booking me for your Uncle Otto's birthday party, and for the generous tip you included. It was a real pleasure to perform for such a fun group of people, and I hope everyone enjoyed it. Oh, and if you happen to get any of the pictures taken last night via email, I sure would love to see them if you feel like forwarding them on.

If I can be of any assistance in the future, please don't hesitate to contact me. Have a great week!

    -Galatea
Certain details might change - like if there's no tip, or if it's obvious no pictures were taken - but that's the basic idea. I only average about 2 gigs a month and the email takes about a minute to send, so I figure why not?

    Re: photo/video clause in contract?

I have a clause in my contract: Taking pictures and videotapingis is allowed for personal use. Please get written permission from me if you want to publish them on the internet.

I printed postcards with my Nikkij portrait on the fromt and my website on the back. If I see a photographer or videographer afterwards, I talk to them and hand them my business card/postcard with a comment like 'I enjoyed performing for this occasion and I'd love to see some of the footage/pictures as a memento.'

About one third of the photographers did send me an email with or without pictures, and I'm very grateful for that!

Unfortunately most picture are caught in the middle of a movement or when I have a silly expression on my face. But still, it's nice that people go make the effort!

For a sneaky way to get around bad photos just say 'no flash photography'. The people who don't know how to deal with low-light will end up with blurry, underexposed pictures. The ones who can deal with it are probably pros or well-educated amateurs. Which means you might get some nice performance photos.

I have a photo/video clause in my contract, but I'm thinking about re-writing it so it's good to see the different versions heren.

And I send an e-mail within 1 or 2 days after the gig in which I include a survey too, I like to get feedback from my clientele!
