    Opening a paypal / Ebay dispute

    Hey!

    I need some advise on how to do this. I have done it in the past, but have forgotten the series of things which I need to do.

    Here is the story:

    I bought this from Ebay: Vintage BELLY DANCING Outfit...Free Texas Arrowhead - eBay (item 150380039961 end time Oct-19-09 19:13:10 PDT)

    My intention, if it is even in half way decent shape, is to renovate it for a friend of mine who keeps drooling on my vintage coin costumes. Well, I sent the payment in timely manner, the package was estimated to arrive on the 27 or 28 Oct. No package. I waited until the following Monday - the US post office is somewhat notorious in my area for it's lack of speed - and no package. I sent a message to the vendor via Ebay's messaging service last Monday (2 Nov.) and still haven't heard from her.

    What next? Should I send her another message saying if I don't hear from you by net Weds (3 weeks after the auction) I will open an Ebay - Paypal dispute? Should I give her more time? Should I start the process now?

    Thanks for your experience and advise.

    Hmmm, did you pay for insurance or upgrade your shipping? If it was sent by regular mail, it may have gotten lost. I use Ebay alot to buy and sell and every so often a package gets "lost" in the mail...sometimes, for whatever reason, the lost package shows up but like a month later. I can't explain it. I would make another attempt to contact the seller...they can probably track the package and it may not be their fault but the 3rd party shipper. It has happened to me before (as a seller) that Canada Post lost my package and then I had to get a refund from them and in turn give a refund to the buyer. Hope this provides some insight...and I hope you get your package!!

    I think You have to wait 45 days to open a dispute isn't it?

    OK just checked , it is between 10 & 45 days you can file for a dispute.but here is a link on how to proceed ( it is the Australia link but will explain how to go about it.

    Or on your own ebay go to help top right corner of page and in the drop down box is problems click on that.

    I suggest you write to seller again and tell them they have 48 or whatever hours to contact you, or you will be opening a dispute.

    I have opened a dispute because the costume I received was not the one in the picture but a super cheap Chinese reproduction. I contacted the seller and asked to have my money refunded and she refused. I told her I would leave bad feedback and open a dispute and she still refused. I described exactly what happened to the disputes department and they had all of our correspondances on file (so be polite, calm and ladylike from the get go) I ended up winning with absolutely no arguement or headache whatsoever. It was easy and pain free. Paypal wants to know that you have attempted to resolve this matter on your own first so make sure you have the emails to show that....or they may even have them like they did with me.

    Tahira,
    You can go to paypal and open a dispute. Wait a few days to see if the vendor responds. If she does not respond or gives you a negative response, you can escalate the dispute to a claim. At that point, paypal will make the final decision. It takes a few weeks. Unless she has a delivery confirmation number and can prove delivery, you will win ( even if you did not pay for upgraded shipping).

    you can open a dispute after 10 days. Then you have 20 days to escalate to a claim. The shipper must provide a tracking number in order to win the claim. Paypal will ALWAYS side with the buyer if the seller does not have a tracking number. But paypal will ALWAYS side with the seller for items that people say are not the wrong color etc.
    This makes it pretty easy to scam on both sides I think. Having been through this many times because I sold full time on ebay for 4 years I can tell you that after you escalate to a claim call paypal and have them handle it for you immediately or at least add notes to your dispute. Seeing that you are calling and actively following the claim makes them resolve faster.

    I have sent her a second message letting her know that I will open a dispute if I don't hear from her / receive the package by Weds.

    I think I know what is going on, though. The auction says that she will ship when she receives a cleared payment. As we know from experience, Ebay / Paypal many times puts ahold on funds from belly dance items because they are considered high risk. So for 21 days or until someone leaves feedback, she won't see the money. While this is supposition on my part I also understand her thinking if this is the case.

    What I wish she would have done is contacted me, let me know, given me the tracking number so I could see that the package was int he system, and i would have left her positive feed back. Now, it really doesnt' matter what she says, I am not leaving positive feedback and if she is trying to start an e-bay business, this will reflect poorly on her.

    Hate to be the bad guy, but. . .

    Just call paypal they will tell you whether the funds are on hold.

    I called Paypal and was told that on my side the transaction was complete. They couldn't tell me if the money was on hold on her side, but that they would wait until Friday (today) to open a dispute if I had not heard from her. This would suggest to me that the money was, indeed, on hold in her account. I have opened disputes with both E-bay and Paypal.

    Hopefully we can get this resolved quickly.

    I had this happen w/ a laptop and it turned out that the seller just didn't ship it. I got my shipping back. This after 30 days of paypal pament. Push the issue but do it factually. Send all correspondence with the complaint as well even if they say they have it.. I got my laptop in a dirty box, barely wrapped w/ food stuck all over the keyboard. I kept it but am SO VERY CAREFUL NOW when I order from ebay and I am an ebay vendor...cr.:

    Lucky I didn't buy that one! I was also thinking of fixing it up for a friend in dance.
