I ordered a gypsy skirt from Magical Fashions on June 9. The status of my order on their website states: "pending payment." So, I send them an email asking if they received my paypal payment and they replied, yes. However, I have not yet received my skirt. The problem is that July 24 is the end of my 45-day window to file a paypal dispute for an item not received. Magical Fashions sent me a short email stating that my skirt is in the mail and they would send me a tracking number. As of today, July 23, I have no tracking number and no skirt. I really don't want to be a bad customer, but should I file a paypal dispute tomorrow, 24 July?

Yes. You can always close the dispute, but once the deadline has passed, there's nothing you can do anymore. File the dispute. I would do it tonight, in fact, to make sure that you don't miss the window.

Of course you should. You paid money, you don't want to lose it. If the company is slacking, no reason you should get stiffed.

Yes, and do it now.
Don't worry about their feelings, you should have recieved the tracking number.

Update: Magical Fashions replied to my paypal dispute, basically stating that my order had shipped, it takes time from India, that they were a reputable vender, and they were deeply offended that I had opened the dispute. Well, I felt bad about that, i.e., I didn't intend to imply that they were disreputable. I replied back to them that anyone making payment through paypal must file a claim within 45 days if the item is not received.

It's amazing how much more quickly, they respond to a paypal dispute.
What about the tracking number?
Don't feel bad about it!
45 days is a LONG time to wait for a skirt!
If they had to order the color fabric needed to make your skirt, they should have kept in communication, and let you know that it will take longer.
I would still have filed the dispute, if I hadn't received the item, to cover myself.
It doesn't ruin their reputation if you receive the item; and you are happy with it, you can end the dispute.
If they were so reputable they should have kept in contact with you; and kept their word and sent the tracking number when they said they would.

They should have looked up the tracking number, and sent it with the short email stating the skirt is in the mail.
Then you would never have had to question their reputation.
Oh, I forgot to ask, when I first posted this.
Did Magical Fashions GIVE Paypal the TRACKING NUMBER?
Once Paypal got involved I think they would have had to give them the number.
I don't think they mailed it yet!
I've ordered things from all over the world (including India), it's NEVER taken over 23 days!
I would have done it, have done it, with no regrets.
(Different seller)
It lights a fire under them, and opens up communication.
I hate it when they try to make you feel quilty, and bad for protecting yourself.

I am glad that you all agreed. I haven't used paypal enough to be that knowledgeable about it. However, I agree with the comment about ordering all over the world and it doesn't take that long. I often find things on ebay from Japan, England, etc., and usually get them very timely. I will let everyone know the status.

Were you advised the skirt was coming from India and not in their US inventory? Even if that was understood the lack of communication was a sign you needed to file a dispute with Paypal. You acted reputably, seems you might be the only one doing so.

I received my order and closed my paypal dispute. The skirt fabric, size and length were perfect. The color was not what was depicted on the website, so it was not what I expected. But, I can live with it.
